For good and valuable consideration, I (“I” or “Me”) grant Mattel, Inc. and Page Activations, and each of their affiliates, subsidiaries, successors and assigns, employees, agents and directors (respectively and collectively, “Mattel” and “Page Activations”), a worldwide, perpetual, irrevocable, royalty-free, sublicensable and transferable license and permission to exercise all copyright and all other legal rights, including but not limited to the unrestricted right to take, use, re-use, publish, republish, and distribute, and to any publicity or privacy rights I may have, to any photographs, GIFs, statements, images, audio and/or video of Me and my children, in whole or in part, without restriction as to changes or alterations, given to or taken or captured by Mattel or Page Activations (the “Materials”).
I agree that Mattel solely owns the Materials and I relinquish any rights, title and interest I may have in them. Mattel may edit or adapt the Materials without my consent or approval and it may publish and/or distribute in print and/or on the internet, sell and otherwise use the Materials at its sole discretion and without any compensation, including but not limited to promotion, advertising, trade, and any related purposes.
I agree that I will not take any action that would impair Mattel’s ownership rights. I hereby release, discharge, and agree to hold harmless Mattel and Page Activations from all loss, damages, claims and demands in any way related to any suit, claim or action related in any way to the Materials, including but not limited to any liability by virtue of any publication of the Materials, including without limitation any claims for libel or violation of any right of publicity or privacy.
I agree not to cause any offensive or controversial imagery to be included in the materials, including profanity, obscene gestures, sexual or suggestive content, violent dangerous or illegal acts, political, religious or social commentary, or discriminatory, derogatory, or disparaging content.
I also indemnify Mattel and Page Activations from all loss, damages, claims and demands in any way related to any suit, claim or action related in any way to my use of the Materials. By proceeding, I confirm that I am 18 years of age or older and I have read and understand this Release.
